Mr. Nick Alfieri’s Agent’s Report has been appended to the minutes.

Mr. Alfieri informed the Commission members that Donald Nielsen, Engineer of Guerriere & Halnon, who represented Garelick Farms for the stormceptor project at their property, has requested to put a smaller stormceptor at the site.  Mr. Alfieri consulted with Mr. Yadisernia regarding this change and he recommended that the applicant keep a log book to record the maintenance checks and make it a perpetual condition.

There was a motion to include the revision of the stormceptor to the STC 2400 Model as recommended by the engineer with the condition that they keep a log book and make it accessible to the Commission.  The motion was seconded and accepted with a vote of 4-0-0.

Permit Decision:  Lot 2, 1086 Pond Street – Schultz – CE159-977
The Commission members and Mr. Alfieri had a discussion regarding the issuance of Orders of Conditions for this project.  There were some Special Conditions for the State permit to be discussed and some Statements of Fact for denying the Local permit to be discussed among the members present at tonight’s meeting.  At the last Conservation meeting, the Commission discussed bifurcating the permits issuing the State permit with Special Conditions and denying the Local permit.

The Commission Chairman informed the Commission members present at the meeting that Nick Alfieri, Conservation Agent, has worked with the Town Attorney to draft some Special Conditions to be appended to the State Orders of Conditions.

The Commission members had an ensuing discussion regarding these proposed Special Conditions to be appended to the State permit, which Mr. Alfieri handed out for their review.

After this review by the Commission members, there were some changes and corrections made.

There was a motion to issue a State Orders of Conditions for Lot 2, 1086 Pond Street with the 44 Special Conditions and the 2 minor edits discussed.  The motion was seconded and accepted with a vote of 4-0-0.

The Commission Chairman stated that regarding the Statements of Facts relative to the Local permit, he had one edit that he suggested be made.  A lengthy discussion ensued among the Commission members regarding their comments and suggested changes to this document.

There was a motion to not issue the Local permit for Lot 2, 1086 Pond Street with the basis of the denial based on the revised Statement of Facts.  The motion was seconded and accepted with a vote of 4-0-0.

There was a motion to adjourn.  The motion was seconded and accepted with a vote of 4-0-0.
The meeting adjourned at 8:15 p.m.
